That I'm not sure of...hopefully some of the others will chime in here. You can file without your spouse but if any accounts are joint accounts, they will go after him for payment. But since they can't touch social security, he may not have to pay anything but I imagine they'll ruin his credit. Definitely have a consultation with an attorney to get definite answers.
