I guess since you don't want the house, it really doesn't matter whether you file before they foreclose or after. But if you file before, the automatic stay will stop them from hounding you for payment on your house and all other debt. Yes, when you file for bankruptcy, you have to account for your money so your attorney can determine which chapter to file.
